Please read these Terms and Conditions carefully before accessing or using our website. By accessing, using any part of the site and/or purchasing something from us, you voluntarily agree to be bound by these Terms and Conditions, (“Terms and Conditions”, “Terms”). If you do not agree to all the Terms of this agreement, then you may not access the website. If these Terms are considered an offer, acceptance is expressly limited to these Terms and Conditions.
These Terms & Conditions contain an Arbitration clause and require you to dispute or resolve any claim with us in Arbitration. By Agreeing to these Terms, you agree to the Arbitration Clause and voluntarily waive your right to a jury trial.

SECTION 1 - ONLINE TERMS
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
SECTION 2 - GENERAL CONDITIONS
We reserve the right to refuse Service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms and Conditions.

The Company has used reasonable efforts in collecting, preparing and providing quality information and material, but does not warrant or guarantee the accuracy, completeness, adequacy or currency of the information contained on or linked to the Website. Users of information from the Website or links do so at their own risk. We reserve the right to modify the contents of this site at any time. You agree that it is your responsibility to monitor changes to our site.
SECTION 4 - PRICING & PAYMENT TERMS
Prices for our services or products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
Accepted payment methods may include Shopify payments, credit/debit cards, paypal, and approved payment providers. Financing or installment options are subject to separate provider terms and approval requirements.

SECTION 6 - COMMUNICATIONS TERMS
By using any communication feature on our website including email, contact forms, live chat, chatbots, SMS/MMS, or other messaging tools you agree that your communications may be recorded, monitored, stored and used by us for customer service, quality assurance, security and compliance. By using these communication channels, you agree to the collection, recording and processing of this information.
By opting into our SMS/MMS service, you agree to receive recurring SMS/MMS messages from and on behalf of SWA Custom LLC d/b/a The Rural Art to the mobile number you provided. Messages may include service-related updates (order updates, account alerts, etc.) or promotional messages (offers, reminders, cart notifications, etc). Message and data rates may apply. Message frequency varies.
You may opt out of the Service at any time by replying STOP, or by clicking the unsubscribe link in any message. You will receive a one-time final text. After you opt out, we will not send further messages unless you subscribe again
By opting in, you confirm that you are the owner or authorized user of the phone number provided and that you give your permission to receive messages from us. Your consent to receive texts is not required to make a purchase.

We may modify or cancel the Service, or any feature of it, without prior notice. Your continued participation after the effective date of any changes constitutes your acceptance of those changes. We are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number and to notify us if your number changes.
If you are located in Texas or have provided your number to us while residing in Texas, messages will include an opt-out mechanism and will honor all opt-out requests. We maintain records of consent, opt-outs, and message logs as required under Texas law. If required by law, we have registered as a “telephone solicitor” with the Texas Secretary of State or confirm that this registration is not required by virtue of an exemption. We follow Texas time-of-day texting rules.
SECTION 7 - REFUND, CANCELLATION & RETURN POLICY
CANCELLATION POLICY
Customers may request cancellation within twenty-four- (24) hours of purchase only. After the 24 hour grace period, no cancellations, refunds, returns, exchanges, modifications or chargebacks will be accepted for any reason. Custom furniture cannot be cancelled, changed, returned, exchanged, or refunded due to buyer’s remorse, change of mind, delays with production or shipping timeline, project or renovation delays, moving or relocation, style preference, failure to measure, color variation, dissatisfaction arising after production has begun or the customer’s inability to accept delivery.
Custom and made-to-order furniture will be final sale and non-refundable after the 24-hour cancellation period. If a refund is approved for an eligible ready to ship item, original shipping, freight, white glove delivery and special handling fees are non-refundable. Refused deliveries do not qualify for refunds. Customers remain responsible for all return freight, storage, redelivery and carrier related fees.
If your order arrives damaged, defective or incorrect, you must notify us within 48 hours of delivery with
1) Your order number
2) Description of the issue
3) Clear photos or videos of the item, packaging and damage.
Claims submitted after 48 hours or without sufficient documentation may be denied. Chargebacks filed for matters covered by these terms may be disputed within proof of policy, acceptance, production records and shipment documentation.
RETURN POLICY REQUEST PROCEDURE
● To initiate a return contact us at info@theruralart.com within 30 days of receiving the product.
● Provide your order number, details of the product, and clear photos showing the condition of the item and packaging.
● Our support team will review the request and provide written confirmation and further instructions if the return is approved.
● Unauthorized returns or items sent back without our written approval will not be accepted and will be returned to the sender at their expense.
If return request is approved, Company may offer the resolution of a replacement item, repair, store credit or refund of the product value only. If a refund is approved, refunds will be issued to the original payment method within a reasonable timeframe, less applicable shipping charges, special handling fees or non recoverable production expenses. Any product damaged during return transit due to poor packaging will not be eligible for refund or replacement. By placing an order, you agree to these policies. We reserve the right to deny refunds that do not comply with this policy.
All custom and made-to-order furniture is final sale and cannot be returned or exchanged. Ready to ship items may qualify for return if the Company is contacted within 30 days of delivery and the return request is approved in writing. The item must be unused, undamaged and returned in original packing. Customers are responsible for return shipping costs.
RESTOCKING FEE
If return is accepted, customers are responsible for all return shipping costs. A 25% restocking fee will be applied to all eligible returns.

For your convenience, this website may contain hyperlinks to websites and servers maintained by third parties. We do not control, evaluate, endorse or guarantee content found on those sites. Any reference made by the Website to any specific commercial product, process, or service (or provider of such product, process or service) by trade name, trademark, hyperlink, or otherwise, does not constitute or imply an endorsement, recommendation, or favoring by this Company. We do not assume any responsibility or liability for the actions, products, services and content of these sites or the parties that operate them. Your use of such sites is entirely at your own risk. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction.

We do our best to protect your personal information but please be aware that no security measures are impenetrable. The transmission of information via the internet is not completely secure and transmission of personal information is at your own risk.

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 15 - NO CHARGEBACKS POLICY
Customer acknowledges that custom product begins shortly after purchase and agrees not to improperly initiate chargeback for valid custom orders in production.
SECTION 16 - TERMINATION
You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or us.
SECTION 17 - INTELLECTUAL PROPERTY
This website and any and all content are owned by the Company. The logo, designs, trademarks, service marks, content and family of trademarks used and displayed on this website and our social media accounts are proprietary intellectual property owned by the Company. The trademarks may not be used without prior written permission from SWA Custom LLC d/b/a The Rural Art .
All materials, including, but not limited to, articles, images, illustrations, designs, icons, photographs, videos and audio files that are part of the Website (collectively, the "Content") are exclusively owned by the Company and protected by trademark, copyright and owned, controlled or licensed by the Company, or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information or restrictions contained in any Content accessed through the Website. No Content from the Website may be copied, reproduced, framed, hyperlinked, republished, downloaded, uploaded, posted, transmitted, or distributed in any way. No use is permitted without prior written permission of the Company.

The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions).
SECTION 19 - RESOLVING DISPUTES, ARBITRATION & GOVERNING LAW
The parties agree to first attempt to resolve disputes through good faith communication and negotiations. If you have a concern, we want to address it, please email us at info@theruralart.com. If unresolved within 60 days, all disputes shall proceed to mediation before litigation. The parties irrevocably and unconditionally submit to arbitration in New Jersey with respect to any dispute or claim with the Company. The Company is not prevented from seeking injunctive relief, intellectual property federal protection, collection actions or emergency equitable relief in court.
SECTION 20 - REFUSAL OF SERVICE OR TERMINATION OF SERVICE
The Company reserves the right to modify products, discontinue products, refuse orders, limit quantities, correct pricing errors or cancel transactions at its discretion. We have the right to terminate your access to any or all of our products and services at any time, without notice, for any reason, including without limitation, breach of these Terms of Service.
