Terms of service
These Terms of Service (“Terms”) govern your use of TheRuralArt.com (“Website”), owned and operated by SWA-KUSTOM LLC, a New Jersey limited liability company (“Company”). By accessing or purchasing from the Website, you agree to be fully bound by these Terms.
Continued use of the Website or placing an order constitutes legal acceptance of all conditions below. If you do not agree with any part of these Terms, you may not access the Website.
1. Product Sales, Production & Shipping
1.1 Scope
The Website facilitates the online sale of solid wood furniture across the mainland United States.
1.2 Made-to-Order Production (Legally Binding)
Most products are custom-crafted and made to order, beginning production immediately after purchase. Because every item is handcrafted specifically for the customer, these items are legally classified as “custom goods,” which are non-returnable and non-cancelable once production begins.
1.3 Estimated Delivery Timelines (No Guaranteed Dates)
- Standard products: 8–10 weeks (estimated)
- Custom items: 10–12 weeks (estimated)
All timelines include production, international freight, customs clearance, and domestic delivery.
All delivery dates are estimates, not guarantees.
Delays do not constitute breach of contract or grounds for cancellation/refund.
1.4 International Transit
Products ship from India or Indonesia to the United States. Transit times depend on external logistics factors including vessel scheduling, weather, customs, and port congestion.
1.5 White Glove Delivery
Certain orders may receive complimentary White Glove Delivery (inside placement, assembly, debris removal). This complimentary service does not alter cancellation or refund eligibility.
2. Cancellations, Returns & Refunds
2.1 Returns (Strictly Limited)
Returns are accepted only for products damaged during delivery.
Damage claims must be submitted within 48 hours with photos/video.
2.2 Cancellations – First 24 Hours
Orders may be cancelled within 24 hours of purchase. A 3.6% non-refundable processing fee (merchant fee) will be deducted.
This fee reflects payment gateway charges that are not reversible.
2.3 Cancellations – After 24 Hours (Before Production)
After 24 hours, cancellations (if production has not yet begun) incur a 25% restocking fee.
2.4 Cancellations After Production Begins
Once production begins, no cancellations or refunds are permitted under any circumstances.
This is legally enforceable because the goods are custom-made, and U.S. consumer protection laws allow sellers to refuse cancellation on custom goods.
2.5 Cancellations After Shipping (Strict No-Cancellation Rule)
Once the order has shipped — internationally or domestically — the transaction becomes fully non-cancellable and non-refundable.
If a customer attempts to cancel after shipping, they will be financially responsible for:
- Two-way international freight
- Customs duties, taxes & port fees
- Storage fees
- Domestic freight charges
- Restocking/disposal fees
These costs typically exceed the product value; therefore, the Company enforces a 100% cancellation fee once shipping begins.
2.6 Refunds Due to Promotions, Offers or Price Changes
Promotional changes, discount adjustments, later sales, or price drops do not qualify for refunds, adjustments, or retroactive discounts.
Orders cannot be cancelled or refunded due to:
- New promotions
- Price reductions
- Seasonal offers
- Coupon codes becoming available later
Customers agree to the price shown at checkout.
3. Delay Policy (Legally Critical)
3.1 Delays Are Not Grounds for Cancellation
Because production and transit timelines are estimates, not guaranteed delivery dates, delays caused by external factors do not permit cancellation or refunds.
External factors include, but are not limited to:
- International shipping delays
- Vessel rerouting
- Weather issues
- Port congestion
- Customs inspections
- Carrier delays
- Geopolitical disruptions
3.2 Goodwill Delay Credits
At the Company’s sole discretion, a small goodwill credit (typically $50–$200) may be issued for meaningful delays.
These credits:
- Are optional
- Are not guaranteed
- Do not represent liability
- Do not alter cancellation rules
4. Chargebacks & Dispute Policy (Strengthened Legal Protection)
4.1 Binding Agreement
By placing an order, the customer agrees that all policies herein are binding and enforceable.
4.2 Chargeback Defense
The following conditions do not qualify for chargebacks and will be disputed and reversed using legal documentation:
- Attempted cancellation after shipping
- Delays within reasonable international transit windows
- Delays caused by external logistics factors
- Customer refusal to accept delivery
- Customer remorse / change of mind
- Customer dissatisfaction due to promotions, discounts, or later sales
- Claims of “item not received” while shipment is en route
- Claims of “product not as described” when natural wood variations occur
- Claims contradicting the Terms accepted at checkout
4.3 Proof Provided in Chargeback Cases
The Company will provide the bank with:
- Order receipt
- Checkout acceptance logs
- Production photos
- Shipping documentation (BL/AWB, tracking, vessel info)
- Communication logs
- Terms & Conditions accepted at purchase
- Courier delivery attempts
- Proof of custom-made production
Chargebacks filed outside these terms may result in the customer being liable for additional collection costs, attorney fees, and damages to recover losses.
5. Customer Responsibilities
Customers are responsible for verifying:
- Dimensions
- Shades and finishes
- Home access requirements
- Delivery address accuracy
- Availability for delivery
- Fit of product into their space
The Company is not responsible for failed deliveries due to inaccurate information or inaccessible property.
6. Intellectual Property
All product designs, photos, 3D renderings, and Website content are exclusive intellectual property of SWA-KUSTOM LLC.
Unauthorized reproduction will result in legal action.
7. Privacy Policy
Customer information is used solely for order processing and logistics coordination.
We do not sell customer information to third parties.
8. Website Disclaimer
All product descriptions and images are as accurate as possible, but natural variations are expected in handcrafted solid wood furniture.
The Company may modify or discontinue any part of the Website or services without prior notice.
9. Limitation of Liability
To the fullest extent permitted by U.S. law, the Company is not liable for:
- Indirect or consequential damages
- Missed deadlines, events, or gatherings
- Customer scheduling conflicts
- Loss of use or opportunity
10. Governing Law
These Terms are governed by New Jersey law.
Any disputes shall be resolved exclusively in the courts of New Jersey, USA.
11. Changes to Terms
The Company may update these Terms at any time without prior notice. Continued use of the Website constitutes acceptance of updated Terms.
